All Vivo customers must agree to our service terms to access the Vivo web site personal broadcasting portal. Vivo ("Vivo", "Vivo Live", "vivolive.com", "we" or "us") provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of vivolive.com (this "Site") and our broadcaster and media player which enables users to stream and broadcast live content (the "Services"). This Privacy Policy applies only to information that you provide to us through the Services. This Privacy Policy may be updated from time to time. We will notify you of any material changes by posting the new Privacy Policy on the Site. Please consult this policy regularly for any changes. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service.

As used in this policy, the terms "using" and "processing" information include using cookies on a computer, subjecting the information to statistical or other analysis and using or touching information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within the United States or internationally.

1. Information Collection and Use

Our primary goals in collecting information are to provide and improve our Services, features and content, to administer your accounts and membership and to enable users to create live streams, customize web pages and share video streams with invited guests. We may use your information in order to better understand how improve our Services.

Vivo uses the information that you provide or that we collect to operate, maintain, enhance, and provide all of the features and services found on the Vivo Service as well as to track user-generated content and Users to the extent necessary to comply as a service provider with the Digital Millennium Copyright Act and other applicable laws.

2. Personally Identifiable Information.

In the course of using the Services, we ask you to provide us with certain personally identifiable information that can be used to contact or identify you and manage your account ("Personal Information"). Personal Information may include, but is not limited to, your name, phone number, credit card or other billing information, email address and home and business postal addresses. We use your Personal Information mainly to provide the Services, bill your account for usage and manage your personal broadcaster and player as well as your invitations and event schedules. You will be contacting regarding your account status and usage.

To protect your privacy and security, we take reasonable steps to verify your identity before granting you account access or making corrections to your information. You must maintain the secrecy of your account as well as your personal passwords. These passwords protect your personal information.

Please be aware that when you register a Vivo account, you will control who can see the videos that you broadcast. We recommend that you guard your personal player URLs and password protect your invitations. These tools are built into the web site. We will not provide any sensitive information or broadcast schedules to other users of the site. Only you control this information.

We also use your Personal Information to contact you with Vivo news, product enhancements and service updates as well as marketing or promotional materials and other information that may be of interest to you. Vivo Users who agree to the terms and conditions of the Vivo Terms of Service Agreement are given the opportunity to opt into receiving such communications from us in the future. Users can unsubscribe at anytime.

3. Use of Log Data

Our servers automatically record or log information that your browser sends when you visit a website ("Log Data"). This log data may include information such as your computer's IP address, browser type or the domain from which you are visiting. We use this information to monitor and analyze use of the Services and for the Site's technical administration. We do not treat Log Data as Personal Information or use it in association with other Personal Information, though we may aggregate, analyze and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information.

4. Use of Cookies

Like many websites, we use "cookies" to collect information and track usage. A cookie is a small data file that we transfer to your computer's hard disk for record-keeping purposes. We use cookies for two purposes. First, we utilize persistent cookies to save your registration ID and login password for future logins to the Site. 5. Emailing Invites via a Vivo Account

As part of the Services, Vivo users are able to communicate with invited viewers. Vivo users select adding one or more email addresses to an online email client, the message they create in the corresponding template can be sent from your personal Vivo site to those email addresses you include. Your email address will be stored but the email addresses that you send your stream to will not be stored in the address file.

6. Compliance with Laws and Law Enforcement.

Vivo Live cooperates with government and law enforcement officials or private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process (including but not limited to subpoenas), to protect the property and rights of Vivo or a third party, to protect the safety of the public or any person, or to prevent or stop any illegal, unethical or legally actionable activity.

7. Business Transfers.

Vivo may transfer or some or all of its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy. If vivolive becomes involved in a merger, acquisition, reorganization or any form of sale of some or all of its assets, we will provide notice to you before your Personal Information is transferred and becomes subject to a different privacy policy.

8. Updating or Removing Your Information

All Vivo users may review, update, correct or delete the Personal Information in their registration profile by contacting us. Vivo Accounts can be suspended or terminated and all personal data will be removed.

Vivo is concerned with safeguarding your information. We use safe business practices and security measures designed to protect your information from unauthorized access. We will make any legally required disclosures of any breach of the security, confidentiality or integrity of your unencrypted electronically stored Personal Data (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on this Site in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

The Services contain links to other websites for product sales and social networking. If you choose to visit an outside site by clicking on another third-party link, you will be directed to that third party's website. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party, nor is it an endorsement of their privacy or information security policies or practices. This Privacy Policy addresses the use and disclosure of information that we collect from you through our Services. 10. Our Policy Toward Children Under 13

Vivo does not knowingly collect personally identifiable information from children under 13. If a parent or guardian becomes aware that his or her child has provided us with Personal Information without their consent, he or she should contact us at support@vivolive.com. If we become aware that a child under 13 has provided us with Personal Information, we will delete such information from our files.

11. International Visitors

For Users visiting the Vivo Service from the European Union or other non-U.S. territories, please note that any data you enter into the site will be transferred outside the European Union or such other non-U.S. territory for use by Vivo and its affiliates for any of the purposes described herein.
